Flask Brands LLC, (“Flask”, "Flask Brands", "Flask Natural Products", “we”, “us”, or “our”) respects your concerns about privacy and values the relationship we have with you. This Privacy Statement describes the types of personal information we collect about our customers, how we use the information, with whom we share it, and the choices available to our customers regarding our use of the information. We also describe the measures we take to protect the security of the information and how our customers can contact us about our privacy practices.

For example, when you browse our store, we automatically collect your computer’s internet protocol (IP) address, in order to provide us with information that helps us learn about your browser and operating system.

We do not rent lists or sell or otherwise disclose personal information we collect about you, except as described herein. We may share your personal information with:

  • Our corporate affiliates.

  • Third party service providers who perform services on our behalf based on our instructions. We do not authorize these service providers to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. Examples of these service providers include entities that process credit card payments, fulfill orders, and provide web hosting, advertising and marketing services.

We also reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with our Privacy Statement. Following such a sale or transfer, you may contact the entity to which we transferred your personal information with any inquiries concerning the processing of that information.

SECTION 4 - CALIFORNIA DO NOT TRACK NOTICE

Under California law, website and online service operators are required to disclose how they respond to web browser “do not track” signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information about a consumer’s online activities over time and across third party websites. We currently do not change our tracking practices in response to “do-not-track” signals or other similar mechanisms.

California law also requires website and online service operators to disclose whether third parties may collect personal information about their users’ online activities over time and across different sites when the users use the operator’s website or service. Third parties that have content or services on our site such as a social feature, analytics service, or an advertising network partner, may obtain information about your browsing or usage habits but this information does not include personal information. These third parties do not necessarily change their tracking practices in response to “do-not-track” signals from your web browser and we do not obligate these parties to honor “do-not-track” signals. SECTION 5 - CONSENT

We will not collect, use or disclose your personal information without your consent. In some cases, we will ask for your consent explicitly. For example, we may ask for your express consent when seeking personal information for marketing purposes, giving you an opportunity to decline.

However, in some cases, we may infer consent from your actions and behavior. For example, when you provide us with personal information to access our website, complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, you consent to our collecting your information. By using our website, you consent to our collecting, using and disclosing of your personal information in accordance with this Privacy Statement.

We may ask you to provide additional consent if we need to use your personal information for purposes not covered by this Privacy Statement. You are not obliged to provide such consent but if you decide not to then your participation in certain activities may be restricted. If you provide additional consent, the terms of that consent shall prevail in the event of any conflict with the terms of this Privacy Statement.

If you do not agree to the collection, use and disclosure of your personal information in this way, please do not use the Flask Brands website or otherwise provide Flask Brands with personal information.

SECTION 6 - SHOPIFY

Our store is hosted on Squarespace Inc (“Squarespace”). Squarespace provides us with the online e-commerce platform that allows us to sell our products to you.

SECTION 7 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. For example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Statement or our website’s Terms of Service.

SECTION 8 – CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. However, no security system is perfect and we cannot promise that information about you will remain secure in all circumstances, including the security of your data during transmission to us or the security of data on your mobile device.

SECTION 11 - AGE OF CONSENT

You must be 18 years old or the age of majority in your jurisdiction in order to make a purchase on our website. If you are under 18 years old or the age of majority in your jurisdiction, then you may not make a purchase on our site. By accessing or using the site, you represent that you are at least 18 years old or the age of majority in your jurisdiction and that you have given us your consent to allow any of your minor dependents to use this site.

We will never knowingly request or collect personal information from any person under 13 years of age without prior verifiable parental consent. We assume that any user of the Site is 13 years of age or older, but if we have good reason to believe that a user is not, we will ask for verification. Children under the age of 13 should always ask their parents or guardians for permission before providing any personal information to anyone online. If we become aware that any individual is under the age of 13 and has submitted any information to us for any purpose without prior verifiable parental consent, we will delete his or her information from our files. In addition, if a parent or guardian becomes aware that a child has submitted personal information, that parent or guardian should tell us that they would like this information deleted from our records by contacting us via email at sales@flaskbrands.com. We will delete the child’s information from our existing files. We reserve the right, in our discretion, to do any one or more of the following in order to verify a minor’s parental permission to use this website:

  • Request a signed form from the parent via email;

  • Request a credit card number, which we will then verify;

  • Take calls from parents on a toll-free telephone number staffed by trained personnel;

  • Request an email from a parent accompanied by digital signature; or

  • Request an email accompanied by a PIN or password.

We reserve the right to modify this Privacy Statement periodically and without prior notice to you. Changes and clarifications will take effect immediately upon their posting on the Flask Brands website.
